Determining The Proper Child Custody Arrangement

There are two main types of child custody arrangements in Pennsylvania. One type is physical custody, which simply refers to where the child will be living most of the time. The other type is legal custody, which refers to who has the right to make important decisions on the child’s behalf, such as those concerning education, religious upbringing, and health care and medical needs.

Custody may be granted to one or both parents. If a parent is granted sole physical and legal custody, then the child will live with that parent and that parent alone will have the responsibility to make decisions on the child’s behalf. However, courts have recognized that having both parents involved in a child’s life is often beneficial, and shared custody agreements are becoming more common. In a shared custody arrangement, both parents share the right of decision-making, and the child moves back and forth between residences according to the terms of the agreement.
